1. Agreement to Terms
These terms and conditions govern the provision of courier and logistics services by Kaprix Powerhouse Logistics (referred to as "we", "us", or "our") to our customers (referred to as "you", "your", or the "Customer"). By booking a courier run, requesting a quote, or using our website, you agree to be bound by these terms in full.
2. Bookings and Quote Calculations
All quotes generated by our online courier calculator or provided by our staff are estimations based on coordinates, postcodes, shipment categories, and selected vehicle specs. We reserve the right to adjust final charges if the actual dimensions, weight, or collection/delivery details differ from those submitted during booking.
3. Courier Carriage and Cargo Guidelines
You represent and warrant that the items handed to our drivers for carriage are packed securely, labeled correctly, and do not contain any illegal, dangerous, or hazardous substances (ADR goods) unless explicitly agreed in writing beforehand. The Customer is responsible for:
- Providing clear loading and unloading contact names, addresses, and instructions.
- Ensuring that someone is present at both collection and delivery points during the scheduled timings.
- Ensuring suitable access for the selected vehicle type (e.g. Luton van, small van) at all stops.
4. Cancellation Policy
We understand that business logistics plans can change. However, since we allocate dedicated drivers and vehicles to bookings, late cancellations impact our fleet operations. If you cancel a booking after the driver has been dispatched or within 60 minutes of the scheduled collection time, a cancellation fee (standard: 50% of the net booking charge or the minimum vehicle charge, whichever is greater) may apply. If a driver arrives at the pickup address and the shipment is unavailable or refused, the full booking amount may be charged.
5. Payment and Financial Terms
All payments for one off or retail courier bookings are processed securely via Stripe prior to collection. For corporate account customers, payments must be made in accordance with the credit terms specified on your invoice (standard: 30 days from invoice date). All amounts are subject to VAT at the prevailing UK rate (20% standard) unless otherwise stated. Late payments will incur interest at a rate of 8% above the Bank of England base rate, plus administrative recovery costs.
6. Limitation of Liability
While we take the utmost care with all cargo, our liability for loss, damage, or destruction of goods in transit is strictly limited. Our liability is capped in accordance with standard UK courier carriage regulations (standard Road Haulage Association - RHA conditions or equivalent transit insurance). We do not accept liability for consequential losses, loss of profits, or business disruption arising from delivery delays, weather issues, motorway congestion, or force majeure events. If you are shipping high value cargo, you must declare the value in advance so we can verify if additional transit insurance coverage is required.
7. Delay and Waiting Time
We allow up to 20 minutes of free waiting time for loading and 20 minutes for unloading. If our driver is delayed beyond this at either collection or delivery points due to factors outside of our control, we reserve the right to bill waiting time at our standard rate (standard: £30.00 per hour or part thereof).
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with our logistics services shall be subject to the exclusive jurisdiction of the English courts.
